JUSTICE ARUN KUMAR ORAL ORDER 18-10-2017 Heard learned Counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Katihar Nagar (Sahayak) PS Case No. 373 of 2017 registered under Sections 341, 147, 323, 324, 504, 354, 379, 448 and 427 of the IPC.

Learned Counsel for the petitioner submits that there is case and counter case between both sides and the allegation is not specific against the petitioner.

As the allegation of assault by iron rod over the head of the informant is specific against the petitioner and the impugned order shows multiple head injury was caused to the informant, so the prayer of anticipatory bail of the petitioner is rejected. However, if the petitioner surrenders and seeks regular bail the same shall be considered on merit without being prejudiced by this order.
