JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 392, 411, 414, 420 of the Indian Penal Code and Sections 25(1-B) a, 26, 27 of the Arms Act. It is alleged that three motorcycle borne criminals robbed the tab, mobile and cash of Rs. 5600/- from the informant. However, on raising alarm, the accused persons including the petitioner were apprehended. From the possession of the petitioner, one live cartridge and cash of Rs. 200/- were recovered.

Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the apprehended accused persons or seized cartridge. The petitioner is languishing in custody since 29.09.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura(Bharrahi) P.S.
