Apprehending their arrest in Sare P.S. Case No. 87 of 2017 registered under section 353 & 379 IPC, sections 4 & 40 of B.M.M.C.R. Act and section 8(d) of the Bihar Mineral (Transportation of illegal Mining Storage and Prevention) Act, 2003, petitioners have prayed for anticipatory bail. It is stated that the allegation of using the tractor(s) for illegal mining is not attributed to the petitioners. It is also not the case against the petitioners that they obstructed in due discharge of the duties of the government official(s). None of the tractors seized by the informant belong to or used by the petitioners. Both the petitioners have clean antecedents. In the facts and circumstances of the case, let the
