JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under Section 302 and other allied sections of the Indian Penal Code, 27 Arms Act and under 3⁄4 of the Dine Act.

Learned counsel for the petitioner submits that there is general allegation against ten persons of having dragged the informant's mother, Sampati Devi whereafter she was done to death. The petitioner submits that there is some dispute between the prosecution side and the accused side. He submits that it would appear that there is dispute between the family of Ganga Paswan and the prosecution side. The petitioner submits that he is not even a distant relative of Gaya Paswan, whereas all other accused are of the same village. The petitioner is in custody since 30.4.2014.

Patna High Court Cr.Misc. No.47519 of 2014 (2) dt.03-03-2015 In the facts and circumstances of the case, the petitioner as mentioned above is directed to be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Patna City in Fatwah Police station Case No. 137 of 2014.
