JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 This application has been filed for cancellation of anticipatory bail granted to O.P.nos. 2 and 3 vide order dated 28.7.2018 passed by Addl. Sessions Judge Ist, Patna City in ABP No.5346 of 2018 under Section 307/34 of the IPC and Section 27 of the Arms Act.

Ground for cancellation of the bail is that there is specific allegation that they fired and in spite of that anticipatory bail has been granted to O.P.no.2 and 3.

Heard learned APP and perused the impugned order from which it appears that the learned Addl. Sessions Judge considering the fact that there is no specific allegation of firing against other accused persons whereas against O.P.no.2 and 3,

Patna High Court CR. MISC. No.60884 of 2018(4) dt.25-02-2020 2/2 there is general allegation of indiscriminate firing and there is also nothing else available on the record and anticipatory bail to O.P.no.2 and 3 was granted in the year, 2018 and there is no allegation of tampering with the evidence or misuse of the privilege of bail or any chance of absconding of the O.P.nos. 2 and 3.

Considering the above fact, I find no merit in this application. Accordingly, this application is dismissed. (Vinod Kumar Sinha, J) chn/- U T
