The petitioner is in custody since 21.05.2014 a case for the offence registered under Sections 273, 274, 420, 120B/34 of the Indian Penal Code and Section 47 of the Excise Act. It is submitted on behalf of the petitioner that the police searched the silver colour Safari vehicle and arrested two persons and in course of search, 40 cartons of liquor in the brand name of Mc. Dowell No. 1 were found in the vehicle. It is further

Patna High Court Cr.Misc. No.47245 of 2014 (2) dt.04-02-2015 2/2 submitted that the vehicle, in question, belongs to one Phul Kumar Mishra.

Considering the fact that that the petitioner is merely a driver of the concerned vehicle from which the alleged recovery was made and also the fact that the petitioner is in custody since 21.05.2014, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Sultanganj P.S. Case No. 116 of 2014.
