In this case, the petitioner is apprehending his arrest in connection with Masrakh P.S. Case No. 194 of 2019 registered for offences under sections 272, 273 of the Indian Penal Code and Sections 30, 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.
The prosecution story in short is that on seeing the police jeep, the petitioner along with other co-accused fled away from the spot throwing the bag but, the co-accused Rajeshwar Prasad was apprehended by the police who disclosed the name of the present petitioner. In course of raiding, the police recovered 37.260 litres of English wine.

Looking to the entire facts and circumstances of the case as also the petitioner having criminal antecedent, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
