2. The petitioner has preferred this application for grant of regular bail in connection with Nautan P.S. Case No. 246 of 2023 dated 20.12.2023 registered for the offences punishable u/s 341, 323, 302, 504, 506, 120B of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused person came to the door of newly constructed house of the informant and started abusing him. In the meantime his son Abhishek Yadav said that he was going to approach Abhishek Mishra and Anup Dixit on his motorcycle. In the morning on 18.12.2023 villagers informed the informant that his

Patna High Court CR. MISC. No.49890 of 2024(2) dt.01-08-2024 2/3 son Abhishek Yadav was brutally killed and his dead body was thrown in the field of wheat crop. Accordingly, on the basis of above application the F.I.R. has been registered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that there is two days delay in lodging the F.I.R. The name of the petitioner has transpired in this case on the basis of suspicion. There is general and omnibus allegation against the petitioner. The other co-accused person has already been granted bail by this court vide order dated 29.04.2024 passed in Cr. Misc. No. 29646/2024. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.03.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation and the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Siwan in connection with Nautan P.S. Case No. 246 of 2023.
