Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no. 2 namely, Ram Ashish Sahani, as he has been arrested.

Accordingly, this bail application is dismissed as withdrawn as against petitioner no.2 namely, Ram Ashish Sahani.

This application for anticipatory bail arises out of Hathauri P.S. Case No. 94 of 2019 for the offence punishable under Sections 147, 148, 149, 341, 323, 332, 333, 336, 353, 379 & 427 of the Indian Penal Code.

No.2530 of 2021(2) dt.16-11-2021 2/2 Learned counsel for the petitioner has produced before me an order dated 12.03.2021 passed in Criminal Miscellaneous No. 33585 of 2020, by which similarly situated co-accused persons namely, Ram Bilash Sahani, Girbal Sahani and Vijay Sahani have been granted anticipatory bail by a coordinate Bench of this Court.

For the reasons mentioned in the order dated 12.03.2021 passed in Criminal Miscellaneous No. 33585 of 2020, this application is allowed. Let the petitioner nos.1 and 3, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Hathauri P.S. Case No. 94 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
