JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Balia P.S. Case No. 130 of 2019 registered for the offences punishable under Sections 30(a), 38(i) and 41(1) of Bihar Prohibition and Excise Act, 2016, pending in the court of Additional Sessions Judge-II-cum-Special Judge, Excise, Begusarai.

Allegation as per FIR is that police on information that petitioner and other accused persons have brought huge quantity of liquor and kept in a house raided the place and recovered and seized 492.625 litres of liquor and petitioner is also named in the FIR.

Submission of learned counsel for the petitioner is that whatever recovery is made that is made from the thatched hut of one Raushan Singh and not from the petitioner and he has

Heard learned APP, who has opposed the prayer for anticipatory bail stating that petitioner is named in the FIR and recovery is made from the house of Raushan Singh, who is son of the petitioner, as such petitioner does not deserve bail. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail. This application is, accordingly, dismissed.
