The petitioners are apprehending arrest in connection with Complaint Case No. 331 (C ) of 2016 for offences under Sections 365/34 of the Indian Penal Code. Counsel for the petitioners does not press this application on behalf of petitioner No. 1.

The application is dismissed as not pressed on behalf of petitioner no. 1, Md. Naseem. However, dismissal of the petitioner will not cause prejudice to the petitioner no. 1 in the event he surrenders and prays for regular bail before the

Patna High Court Cr.Misc. No.62433 of 2018(3) dt.13-12-2018 2/2 court below. The Court below is directed to dispose of the bail application on its own merit on the same day without being prejudiced by this order.

Considering the statement of the victim under Section 164 Cr.P.C. the court is inclined to grant anticipatory bauil to petitioner nos. 2 to 4 Let the petitioner nos. 2 to 4, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate -cumSub Judge-III, Barh, Patna in connection with Complaint Case No. 331 (C ) of 2016, subject to the conditions as laid down under Section 438(2) Cr. P. C.
