This application, for grant of anticipatory bail, arises out of Raniganj Police Station Case No. 95 of 2017, disclosing offences under Section 7 of the Essential Commodities Act. Learned counsel for the petitioner has submitted that the petitioner happens to be PDS dealer of Gram Panchayat Pachira and his P.D.S. shop had been inspected on the date of occurrence by the Block Supply Officer, Raniganj and no irregularity has been found by the officer in the stock. Nothing has been recovered from the possession of the petitioner. Therefore, no case under Section 7 of the E.C. Act is made out against the petitioner. Hence, the petitioner deserves the

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Raniganj Police Station Case No. 95 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
