Learned counsel for the petitioner undertakes to remove the defects within three weeks of normal functioning of the court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Sections 363/366A of the Indian Penal Code.

Vide order dated 30.01.2021, a report was called for in connection with Special Case No. 166 of 2019 arising out of Khusrupur P.S. Case No. 48 of 2018 from the court of the learned Additional District Judge-1st, Patna. Report has been

No.2632 of 2021(3) dt.01-03-2021 2/2 sent by letter no. 31 of 2021 by the Additional District and Sessions Judge-VII-cum-Exclusive Special Court (POCSO Act), Patna in which it is stated that charge has been framed against the petitioner on 07.11.2019 and at present case record is running for prosecution evidence and next fixed date is on 17.02.2021.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Special Case No. 166 of 2019 arising out of Khusrupur P.S. Case No. 48 of 2018 pending before the court of the learned Additional District Judge, 1st Patna.

Accordingly, the application is dismissed. However, the learned court below is directed to conclude the trial within six months.
