====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-07-2021 Heard Mr. Syed Masleh Uddin Ashraf, the learned Advocate for the petitioners and Mr. Ram Priya Sharan Singh, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Ishakchak P. S. Case No.60 of 2020, instituted for the offences under Sections 341, 323, 324, 504, 506, 448, 380, 384, 379, 307/ 34 of the Indian Penal Code. Though the petitioners have been named in the F.I.R. but there is no specific accusation against them. It has been alleged in the F.I.R. that on a very trivial issue, an occurrence took place in which the many persons took part. The act of assault but has been attributed to co-accused

Patna High Court CR. MISC. No.2874 of 2021(2) dt.23-07-2021 2/2 Md. Anjum Akhtar @ Gudda, Md. Jawed and Md. Rizwan Rizvi. None of the victims are stated to have received any grievous injury.

Be that as it may, the petitioners are only the members of the mob and have not been alleged to have done anything. Regard being had to the afore-stated facts, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P. S. Case No.60 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
