JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 506 and other sections of Indian Penal Code and Section 27 of Arms Act. As per prosecution case, on the order of co-accused Bharat Yadav, all the FIR named accused persons including this petitioner assaulted the informant and family members by means of deadly weapons. Allegation against this petitioner is of firing from the rifle and causing injury to the brother of the informant.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. A scuffle took place between the parties due to land dispute in which both sides sustained injury. Injury allegedly

It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by this Hon'ble Court vide order dated 28.11.2022 passed in Cr. Misc. No. 40518 of 2022. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Saharsa in Nauhatta (Darhar O.P) P.
