2. The petitioner seeks bail in a case registered for offence under Section 103(1) of the B.N.S., 2023.
3. As per F.I.R., on 11.03.2025 at about 5 AM, when informant woke up and saw that his son is not present in the house and subsequently, at about 6 AM, one Sukesh Kumar came and informed that someone has killed informant's son and thrown his body near Nimiya Aahar. On receipt of such information, informant went there and saw the dead-body of his son and also saw mobile phone of his son in broken condition.
4. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation in the
Patna High Court CR. MISC. No.51975 of 2025(3) dt.07-11-2025 2/2 confessional statement of co-accused Soni Devi, who disclosed that she was having illicit relation with informant's son and this fact was known to her husband, her brother-in-law (petitioner) and her nephew, who came to search her and found her with the deceased in a compromising condition, thereafter, this petitioner caught hand of informant's son, Soni Devi pressed his mouth and her husband namely Shiv Chauhan pressed his (informant's son) neck with the help of Gamachha and killed him.
5. Considering the same, the prayer for bail of petitioner is rejected.
