Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Though the petitioner was not there at the time of recovery of liquor, however, petitioner has got criminal antecedent.

Considering criminal antecedent of the petitioner, in my view, this is not a fit case for grant of anticipatory bail in connection with Daudnagar P.S. Case No. 17 of 2020 pending in the Court of learned Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad/successor Court. Hence, prayer for

Patna High Court CR. MISC. No.2604 of 2021(2) dt.15-11-2021 2/2 anticipatory bail is refused.

In the event of surrender of the petitioner within a period of two weeks from the date of receipt/production of a copy of this order, the prayer for regular bail shall be considered by the learned Court below without being prejudiced by this order.
