2. In this case, the petitioner is seeking regular bail in connection with Chainpur P.S. Case No. 173 of 2024, registered for the offences punishable under Sections 25(1-B), (a) 35 of the Arms Act.

3. As per allegation, on the basis of a viral video on social media, the informant apprehended the petitioner, who is alleged to have demonstrated the pistol. Further, on the information given by the petitioner, the police raided the house of co-accused whose name is also Sandeep Kumar, son of Prabhu Pasi, and recovered the alleged pistol from his house.

4. The learned counsel for the petitioner has

Patna High Court CR. MISC. No.49994 of 2024(2) dt.26-07-2024 2/2 submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. From perusal of the FIR, a country-made pistol was recovered from co-accused whose name is also Sandeep Kumar but his father's name is Prabhu Pasi. Nothing has been recovered from possession of the petitioner and he is under custody since 19.05.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 173 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
