The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 308, 386, 427, 504, 506 of the Indian Penal Code.
The accusation is of making assault to the informant, his son by all the F.I.R named accused persons including the petitioner. The petitioner and coaccused Vijay Yadav are alleged to have assaulted with lathi on the head of the brother of the informant. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.56871 of 2021(2) dt.20-06-2022 2/2 petitioner that in the background of some land dispute, the present F.I.R has been registered. There is counter version of the occurrence also and petitioners' side also received injuries. There is no accusation of repeating the blow. Moreover, a compromise has also taken place between the parties.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Nautan P.S. Case No. 417 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
