JUSTICE PARTHA SARTHY ORAL ORDER 19-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Piro P.S. Case no. 80 of 2020 registered under sections 392, 402 and 414 of the Indian Penal Code and sections 25(1-B)(a) and 26 of the Arms Act. As per allegation in the FIR, a live cartridge was recovered from the possession of the petitioner while arms and cartridges were recovered from other accused persons. It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from the person or possession of the petitioner who is in custody since 23.3.2020 i.e for more than a year and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Piro Case no. 80 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
