Nobody appears on behalf of the State.

The petitioner seeks bail in Malsalami P.S. Case No. 47/04 registered under section 366/34 IPC. The FIR was lodged by the brother of the victim four days after the occurrence alleging therein that on 24.01.2014 his sister aged about 15 years had gone outside to attend the call of nature but did not return till late night. A search was made whereafter it was revealed that his neighbour Gorak Sahni had kidnapped her for the purpose of solemnizing marriage with her. Further allegation is that the petitioner being the father of the boy and other family members have connived with the boy.

The contention is that the petitioner is the father of the

Patna High Court Cr.Misc. No.48183 of 2014 (2) dt.04-03-2015 2 / 2 boy and the entire family has been made accused in order to exert undue pressure. The girl is safe and presently residing with her maternal mother-in-law. The petitioner will cooperate in investigation as and when required.

Regard being had to above, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Patna City in connection with Malsalami P.S. Case No. 47/14 on conditions that one of the bailors of the petitioner shall be own/close family member. In the event of framing of charge the petitioner shall continue to appear in person on the date(s) fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel the bail bonds and secure his arrest in accordance with law. (Kishore Kumar Mandal, J) HR/- U
