Although, the learned counsel for the petitioners tried to pursue this Court reasoning out of the facts which promoted the petitioner to prefer the present petition against the order passed in Cr. Revision No. 485 of 2013.

He agrees on the point that while setting aside the order dated 18.6.2013 by learned Judicial Magistrate-1st Class, Patna City in C.A. No. 844 of 2011, the concerned Court directed to pass fresh order in the light of law and facts and as

Patna High Court CR. MISC. No.23534 of 2015(9) dt.15-02-2023 2/2 such all the opportunities are available to the petitioner to agitate the same before the concerned Court.

Taking into account the aforesaid facts, the learned counsel for the petitioners submit that he may be permitted to raise all the points before the concerned Court before an order is passed, if still not passed, in the light of the order dated 30.3.2015 passed in Cr. Revision No. 485 of 2013 by the Court Adhoc Additional District and Sessions Judge-VI, Patna. In the light of said fair submission put forward by the learned counsel for the petitioners, the present petition stands disposed of giving liberty to the petitioners to raise all these points before the concerned Court.
