JUSTICE SATYAVRAT VERMA ORAL ORDER 23-02-2022 Heard learned counsel for the petitioners and Dr. Kumar Uday Pratap, learned A.P.P. for the State. The petitioners seek bail in connection with POCSO Case No. 47 of 2021 arising out of Karjain P.S. Case No. 85 of 2021 instituted for the offences under Sections 323, 376, 506 and 34 of the Indian Penal Code read with Section 4 of the POCSO Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 11.07.2021 and 30.07.2021 respectively, are persons with clean antecedent, charges have been framed and trial has commenced.

Learned counsel for the petitioners draws the attention

Patna High Court CR. MISC. No.56435 of 2021(2) dt.23-02-2022 2/2 of the Court to Annexure 4A to the supplementary affidavit to submit that in the trial the informant has categorically stated that the petitioners have not committed any occurrence with the informant.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent, charge-sheet has been submitted in the case and the informant has not supported the prosecution case in the trial, let the petitioners above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI-cum-Special Judge, POCSO, Madhubani /Incharge Successor court in connection with POCSO Case No. 47 of 2021 arising out of Karjain P.S.
