JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Marhowrah P.S. Case No. 234 of 2016 dated 25.05.2016 instituted for the offences under Section 392 of the Indian Penal Code.

The petitioner is not named in the F.I.R and his name has transpired only in the confession of an arrested accused person. There is no recovery from the petitioner or from his constructive possession. The petitioner has not been put on Test Identification Parade.

Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioner, the petitioner, above named, in the event of his arrest or

Patna High Court Cr.Misc. No.61416 of 2018(3) dt.28-01-2019 2/2 surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah P.S. Case No. 234 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
