Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Rajnagar P.S. Case No. 197 of 2021 registered under Section 366(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 14.07.2021, charge-sheet has been submitted and is a person with clean antecedent and the informant alleges that his minor daughter was kidnapped by the petitioner for marriage. Learned counsel submits that the victim is not a minor, rather she is a major as would be evident from the statement made under Section 164 of the Cr.P.C. where she

Patna High Court CR. MISC. No.57219 of 2021(2) dt.02-03-2022 2/2 has disclosed her age as 18 years and the victim has also not supported the prosecution case and has stated that she has married the petitioner.

Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and is a person with clean antecedent and the victim has not supported the prosecution case in her statement under Section 164 of the Cr.P.C. and has disclosed her age as 18 years, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Ist, Madhubani/ Successor Court in connection with Rajnagar P.S. Case No. 197 of 2021.
