The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.
It is a case of dowry death of the deceased due to nonfulfillment of dowry demand by the accused persons including the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is a Bhaisur of the deceased and he has no concern with the mess and business of the deceased and her husband, namely, Baulal Paswan, who has been granted anticipatory bail by a Co-ordinate Bench of this Court passed in
Patna High Court CR. MISC. No.56989 of 2021(2) dt.06-07-2022 2/2 Cr. Misc. No.13428 of 2020 and also other co-accused persons have already been granted anticipatory bail by another Coordinate Bench of this Court passed in Cr. Misc. No. 80139 of 2019. Petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 495 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
