1. Heard the parties.

2. Learned counsel for the petitioner submits that the case of the petitioner is fully covered by the judgment of this Court passed in C.W.J.C. No. 3360 of 2017 dated 26.09.2023 and C.W.J.C. No. 4506 of 2016 dated 04.10.2016.

3. Learned counsel for the State submits that it is correct that the fact of the case is identical to the fact of the aforesaid

Patna High Court CWJC No.11690 of 2016(8) dt.25-07-2024 2/2 two cases.

4. In view of the submission of the parties, the present writ application is disposed exactly in terms of the order dated 26.09.2023 passed in C.W.J.C. No. 3360 of 2017. Accordingly, the impugned order dated 28.06.2016 is set aside.

5. The writ application is allowed with a direction that the petitioner shall be reinstated in the service with all consequential benefits like the petitioners of C.W.J.C. No. 4506 of 2016 and C.W.J.C. No. 3360 of 2017.

6. Accordingly, the present writ application is disposed with the aforesaid directions.
