JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-05-2022 Heard learned Advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Sakra P.S. Case No. 294 of 2021 dated 02.06.2021 instituted for the offences under Sections 147, 272, 273, 353, 467, 468, 469, 471 of the Indian Penal Code and Section 30(a), 36 and 47 of the Bihar Prohibition and Excise Act, 2016.

From the hut of the petitioner, 561.600 litres of liquor has been recovered. In the same operation, 168 litres of liquor is said to have been recovered from an orchard which belongs to the brother of the petitioner.

The petitioner is in custody since 02.06.2021 and four other accused persons of this case with similar allegation have been granted bail by a coordinate Bench of this Court.

No.57428 of 2021(2) dt.23-05-2022 2/2 Considering the period of custody and the nature of offence and the the petitioner having no criminal antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Sakra P.S. Case No. 294 of 2021.
