JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-03-2021 Heard Mr. Ashok Kumar Singh, learned counsel for the petitioner and Mr. Chandra Sen Prasad Singh, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Daudnagar PS Case No. 221/2020 registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 504/34 of the IPC.
The allegation against the petitioner, as per First Information Report, is that he along with other accused persons assaulted the informant and one Parshuram Chaudhary by means of Lathi, Danda, sword and axe due to which, they sustained injury.
Learned counsel for the petitioner submits that both the parties are co-villagers and the occurrence took place on a trivial issue of sacrificing a goat during auspicious occasion of Saptami and the allegation against the petitioner is general and omnibus in nature. Learned counsel, referring to Annexure-3
Patna High Court CR. MISC. No.2580 of 2021(2) dt.12-03-2021 2/2 and 3/1, submits that the injuries caused to the victims are simple in nature except two injuries for which opinion is reserved. Learned counsel next submits that petitioner is in custody since 03.08.2020 being a man of clean antecedents. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that both the parties are co-villagers and the injuries caused to the victims are simple in nature and petitioner being in custody since 03.08.2020, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, UDAL MAHTO @ UDAL KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Daudnagar PS Case No. 221/2020.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
