JUSTICE SATYAVRAT VERMA ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and Shri Rajendra Prasad Nat, learned A.P.P. for the State. The petitioner seeks bail in connection with Ramnagar P.S. Case No. 346 of 2020 instituted for the offences under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.09.2020, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that two criminals looted his motorcycle and were fleeing but the informant with the help of a person chased them and when the informant reached near Pakri Chowk, he saw his motorcycle lying on the road and a person in an injured condition, who was the petitioner.

No.57051 of 2021(2) dt.24-02-2022 2/2 Learned counsel for the petitioner submits that the petitioner is a co-villager and is known to the informant and as such he would never have indulged in an act getting himself implicated easily. It is further submitted that the person who had looted the bike was fleeing away and in haste he dashed the petitioner and the petitioner became injured and thereafter under mistaken identity, the informant thought that it was the petitioner who along with other co-accused has looted his bike. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.09.2020, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st Bagaha, West Champaran in connection with Ramnagar P.S. Case No. 346 of 2020.
