JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-03-2015 The petitioner is in custody since 29.9.2014 in relation to Dandkhura P.S.Case No. 48 of 2014 instituted under Sections 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner draws attention of this Court to the fact that the only fact implicating the petitioner is that after the mobile had been stolen and after few days the petitioner had used his SIM in that mobile. Learned counsel submits that the petitioner is related to the person having purchased the mobile as secondhand.

Be that as it may, in the facts and circumstances, let the petitioner Md. Rafique @ Farique be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Dandkhura P.S.Case No. 48 of 2014.
