ANJANA MISHRA ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.06.2019 in connection with Biraul P.S. Case No.330 of 2017 registered for the offence under Sections 30(a)/38(i)/41(i) of the Bihar Prohibition & Excise (Amendment) Act, 2016 and Sections 272, 273, 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the name of the petitioner has surfaced in the confessional statement made before the police by a coaccused, who has since been extended the privilege of bail. The petitioner is not having any criminal antecedents. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on
