04-03-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in Salimpur P.S. Case No. 24 of 2014 dated 06.02.2014 instituted under Sections 25(1-B) (a)/26 of The Arms Act, 1959.
Learned counsel for the petitioner submits that though as per the allegation, he has been caught with one loaded country made pistol but the same has been planted on him. It is submitted that the petitioner is in custody since 07.02.2014. Learned A.P.P. opposes the prayer for bail and submits that the petitioner in involved in five other cases under various sections of the Indian Penal Code including 379/392/395 and thus does not deserved any indulgence.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on bail. Accordingly, the
Patna High Court Cr.Misc. No.47365 of 2014 (2) dt.04-03-2015 2/2 application stands dismissed.
However, the Court below shall expedite the trial and conclude the same within six months.
