The petitioners seek pre-arrest bail in connection with Atri P.S. Case No.158 of 2018 registered for the offences punishable under Sections 147, 148,149, 448, 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the petitioners are father and son respectively. There is admitted land dispute between the parties. For an occurrence, which took place on 31.05.2018, a case and counter case was registered. He contended that though it is alleged that the petitioners were armed with pistol, there is no allegation that

Learned counsel for the State being assisted by the learned counsel for the informant opposed the application for grant of pre-arrest bail to the petitioners.
Considering the nature of allegation as also the submissions advanced on behalf of the parties, in the event of arrest or surrender in the court below within a period of six weeks, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIII, Gaya in connection with Atri P.S. Case No.158 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J.) Sanjeet/- U T
