2. The present application, for grant of anticipatory bail, arises out of Barharia Police Station Case No. 224 of 2025, registered on 01.05.2025 for the offences under Sections 126(2), 115(2), 118(1), 109, 303(2),127(2) 352, 3(5) of the BNS.
3. As per the First Information Report, on 30.04.2025 at about 9.00 PM while the informant was returning home from Tilak ceremony, the petitioners and other accused persons surrounded him, abused him and assaulted on his head. It has further been alleged that they were carrying sword, Farsa and other sharp edged weapons. The accused persons also snatched

Learned counsel for the petitioners submits that the petitioners have not committed any offence as alleged in the FIR and they have falsely been implicated in this case due to the fact that on the same date of occurrence, the informant misbehaved with the sister of co-accused, Hasindra Singh for which Barharia PS Case No. 223 of 2025 was lodged against the informant and in retaliation, the informant has lodged the present FIR ( Barharia PS Case No. 224 of 2025) after the FIR having been lodged by the side of the petitioners. It has next been submitted that the injury sustained by the informant is found to be simple in nature as would be evident from injury report (Annexure-3).
5. Learned APP opposed the prayer for anticipatory bail of the petitioners.
6. Regard being had to the submissions made by the parties and taking into consideration the fact that there is case and counter case between the parties and the injury sustained by the informant is simple in nature, I am inclined to grant the petitioners the privilege of anticipatory bail.
7. Let the petitioners, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.45349 of 2025(2) dt.30-07-2025 3/3 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Siwan in connection with the aforesaid Police Station Case subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
