JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under section 302 of the Indian Penal Code.

It is alleged by the informant that the petitioner gave knife blow to her daughter Soni Kumar, aged about 15 years, who wanted to pursue her study which was protested by him.

Learned counsel for the petitioner submits that the informant Budhiya Devi was examined as P.W.6 in S.T. No.407 of 2014 and she did not support the prosecution case. Some other witnesses have also not supported the prosecution case. The petitioner is in custody since 20.12.2013.

As the trial is more than halfway through, I am not inclined to grant bail to the petitioner. The prayer for bail is accordingly rejected. However, the trial court is directed to conclude the trial of the petitioner within three months from the date of receipt/production of a copy of this order, failing which, the petitioner may renew his prayer for bail.
