JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-07-2019 This is an application for grant of anticipatory bail in connection with Andharamath P.S. Case No.59 of 2019, corresponding to G.R. No.676 of 2019, disclosing offences under Sections 272, 273 of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Police got a secret information that huge quantity of liquor was recovered by the police from the Scorpio vehicle. The petitioner and other accused persons are engaged in trade of liquor. Police has also got an information that Scorpio vehicle has purchased by the petitioner, on that, police raided, on seeing the police party, the accused persons succeeded in fleeing away from the spot and from the Scorpio vehicle huge quantity of liquor has been recovered.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.45168 of 2019(2) dt.23-07-2019 2/2 that he has falsely been implicated in this case, having no criminal antecedent. The vehicle was ridden by one Ashok Kumar Singh.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that F.I.R. itself shows that vehicle is of the petitioner and he was also present there but he succeeded in fleeing away.

Having heard both sides, in view of the allegation and the quantity of the liquor recovered from the Scorpio vehicle of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, he may surrender before the learned court below and make prayer for regular bail.
