Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Barahat P.S. Case No. 81 of 2022, lodged under Sections 366(A)/34 of the Indian Penal Code.

As per prosecution case, the informant has alleged that her daughter was alleged to be kidnapped by four named accused persons with a view to marry.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that the alleged abducted girl has already been recovered and in her statement recorded under Section 164 of

Patna High Court CR. MISC. No.47537 of 2022(2) dt.24-11-2022 2/2 Cr.P.C. before the Magistrate, she has not alleged anything against the present petitioner, rather she alleged that she entered into marriage and wants to live with her husband i.e. the present petitioner.

Learned A.P.P. for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Barahat P.S. Case No. 81 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
