2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 30 (a) and 41 (i) of Bihar Prohibition and Excise Act.
3. It is alleged that 5.70 liters of illicit liquor have been recovered from the motorcycle of which petitioner is registered owner.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. The motorcycle of the petitioner was used by other persons for transportation of illegal liquor without his knowledge and consent. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition.
6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise court II, Siwan in connection with Nautan Police Station Case No. 174 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
