JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2017 Both the aforesaid applications arise out of Bahadurganj P.S. Case No. 24 of 2017, registered under Sections 366(A) and 372/34 of Indian Penal Code. Therefore, both the aforesaid applications have been heard together and are being disposed of by this common order.
The accusation is that on 12.10.2016 informant had

No.41124 of 2017 (3) dt.15-12-2017 2/3 gone to see the fare, where Zishan (Petitioner of Criminal Miscellaneous No.45285 of 2017) met him, which was known to earlier and Zishan gave him mobile to the informant on purchasing the same and she return to her house, but Zishan used to talk her on mobile, On 29.01.2017 he called the informant at Bahadurganj Telephone Exchange then she moved for there to her house where Zishan and Firoj along with five persons were present and boarded her in the vehicle and she was carried at a distance and kept in room of a hotel and she was also kept in the house of sister of Firoj, where all used to talk to sell her then she made protest thereafter, Zishan and Firoj carried the informant Kishanganj for carrying her to Delhi, but in the meantime on seeing the Police, informant raised alarm and Firoj was apprehended.
Learned counsel for the petitioners submits that, in fact, petitioners are innocent and they have falsely been implicated in this case.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trail
Patna High Court Cr.Misc. No.41124 of 2017 (3) dt.15-12-2017 3/3 Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
