JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Teragach P.S. Case No. 79 of 2017 dated 06.10.2017 instituted for the offences under Sections 302, 201, 34 of the Indian Penal Code.

From the perusal of the F.I.R, it appears that petitioner is not named in the F.I.R and he has been named only in the further statement of the informant. The material against the petitioner is that he was last seen with the deceased and after the dead body was recovered, the petitioner absconded himself for some time. There is no eye witness to the occurrence.

Considering the aforesaid bleak nature of evidence collected against the petitioner, the petitioner, above named,

Patna High Court Cr.Misc. No.61096 of 2018(3) dt.23-01-2019 2/2 in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Kishanganj in connection with Teragach P.S. Case No. 79 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
