Heard the learned counsel for the petitioner as well as Mr. J. N. Thakur, the learned Additional Public Prosecutor for the State through video conferencing.

The petitioner is seeking regular bail in connection with Alamnagar P.S. Case No. 50/2022 registered for offence punishable under sections 364, 302, 201 read with 34 of the Indian Penal Code and 27 of the Arms Act.

As per allegation, on 04.03.2022 at about 9:00 P.M., the son of the informant, Rikesh Kumar went with his friend Sintu Kumar from his house by a motorcycle to attend a marriage ceremony. Thereafter, he left his friend Sintu Kumar

When Sintu Kumar called him on mobile, Rikesh Kumar told him that he is nearby and would come back in 10-20 minutes. After some time, Sintu Kumar again called him, but his call was received by some unknown persons, who abused Sintu Kumar and since then, the son of the informant was missing. In the next morning, the informant was apprised that the dead body of his son was found from a pit. The informant has stated further that his son was taking with one Lusi Kumari and it was the reason that the family members of Lusi Kumari, named in the FIR, have killed the deceased and disappeared his dead body.

The learned counsel for the petitioner has submitted that the petitioner is a lady. She is mother of Lusi Kumari and she has no concern with the alleged occurrence. He has submitted further that eight accused persons have been arrayed in the FIR with allegation of murder of the deceased. The informant has implicated even the female members of the family and they are not supposed to have indulgence in the alleged murder. The petitioner is under custody since 07.03.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on

Patna High Court CR. MISC. No.47494 of 2022(2) dt.09-12-2022 3/3 bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Udakishunganj in connection with Alamnagar P.S. Case No. 50/2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
