The petitioner who is in custody since 31.03.2019 has filed the instant application for grant of bail in connection with Ramnagar P.S. Case No. 53 of 2019 (District West Champaran) registered for the offence punishable under sections 20B and 22A of the NDPS Act.

As per the allegation in the FIR, on information being received that four persons were carrying Ganja, the police party stopped them for checking. It is stated that two persons managed to escape while two persons i.e the petitioner and one Afak Alam were arrested.

It is submitted by learned counsel for the petitioner that allegedly 5 kg Ganja were recovered from the possession of

Patna High Court CR. MISC. No.43319 of 2019(3) dt.27-09-2019 2/2 the petitioner while 4.7 Kgs were recovered from one Afak Alam who has been enlarged on bail by order 22.07.2019 in Cr. Misc. No. 44331 of 2019. The petitioner is in custody since 31.03.2019 and has no criminal antecedent The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration that the petitioner is in custody 31.03.2019, he has no criminal antecedent and that the coaccused has been granted bail, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, West Champaran, Bettiah in connection with Ramnagar P.S. Case No. 53 of 2019.
