1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Mahua P.S. Case No. 197 of 2022 dated 29.03.2022 registered for the offence(s) punishable under Section(s) 304(B)/306 read with Section 34 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioner are that petitioner is uncle of the deceased and against him there is a simple allegation of having abated the victim to commit suicide but the said allegation is completely false and from the facts of the FIR, it is clearly evident that the alleged act of this petitioner does not fall in the purview of abatement and moreover the husband and in-laws of
Patna High Court CR. MISC. No.47092 of 2023(2) dt.01-08-2023 2/2 the deceased, who have been accused with same type of allegation, have been granted bail by different co-ordinate Benches of this Court vide Annexure 1 series. Further submissions are that petitioner has been languishing in jail since 12.12.2022 and against him, the investigation has been completed.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions and mainly taking into account the petitioner's custody period as well as the circumstances pointed out by the petitioner's counsel which go in petitioner's favour, this court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be enlarged on bail in connection with Mahua P.S. Case No. 197 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
