The petitioner apprehends his arrest in connection with Azamnagar (Salmari O.P.) P.S. Case No. 152 of 2014 registered under Sections 363/366(A) of the Indian Penal Code. The accusation is that petitioner kidnapped Lakhi Kumari, minor daughter of the informant with a view to solemnize marriage with her.

Learned counsel appearing on behalf of the petitioner submits that in fact, victim Lakhi Kumari, daughter of the informant is major. In her statement as recorded under Section 164 Cr. P.C., she stated that she moved with the petitioner according to her sweet will and her age has been assessed by the Doctor in between 18 to 19 years, which would appear from Annexure-2 of the application.

No.47547 of 2014 (2) dt.23-04-2015 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Katihar in connection with Azamnagar (Salmari O.P.) P.S. Case No. 152 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
