Heard learned counsel for the appellant, informant and learned Special Public Prosecutor for the State. This is an appeal under section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, (hereinafter in short referred to as the 'SC/ST Act') against the refusal of prayer for bail vide order dated 23.09.2020, passed by learned Special Judge (SC/ST Act) Patna, in connection with Special Case No.86 of 2020, registered under sections 498A, 504 and 506 of the IPC and Sections 3(1) (s)(w)(i)/3 (1)(v)(2) of SC/ST Act.
It is submitted by learned counsel for the appellant that the appellant is innocent and has not committed any offence. He
Patna High Court CR. APP (SJ) No.472 of 2021(6) dt.03-01-2022 2/2 submits that there is general and omnibus allegation levelled against the appellant. He submits that appellant has no criminal antecedent as stated in para-3 of this appeal. Learned Spl. PP for the State and informant opposed the prayer for bail and submit that there is specific allegation against the appellant to abuse the informant by taking caste name.
Considering the facts and circumstance of the case, I am not inclined to enlarge the appellant on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Special Case No. 86 of 2020.
Accordingly, this appeal is dismissed.
