Petitioner is in custody in connection with Sessions Trial No. 35 of 2013 arising out of Bhagwanpur P.S.Case No.92 of 2011 pending in the Court of FTC-cum-Adhoc ADJ-V, Vaishali at Hajipur registered for an offence under Sections 448, 376, 511 and 307 of the IPC.

The earlier bail application of the petitioner was rejected vide Cr.Mics.No.45245 of 2012 dated 26.04.2013. This is the second attempt for grant of regular bail on behalf of the petitioner. A report was called for from the trial Court, the same is kept at flag-'M'. It has been reported that the trial is likely to be concluded within three months if the prosecution produces the

Patna High Court Cr.Misc. No.50530 of 2014 (4) dt.02-08-2016 medical officer for his examination.

Considering the fact that there is main allegation against this petitioner, I am not inclined to grant bail to the petitioner, the same is rejected.

Anyhow, the trial Court is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of a copy of this order. The Superintendent of Police, Vaishali at Hajipur is directed to ensure that the medical officer is produced on behalf of the prosecution on the date fixed by the trial Court.
