====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 11-08-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends arrest in connection with Begusarai Town P.S. Case No. 329 of 2022 dated 05.06.2022, instituted for the offence punishable under Sections 302, 201 & 120 B of the Indian Penal Code.
3. The prosecution case, in short, is that the informant alleged in the fardbeyan on 05.06.2022 is that his brother, namely, Abdul Wakil (deceased) was residing with his second wife and a two years' son. On 02.06.2022, the informant got an information that his brother was missing. Thereafter, he tried to search his brother from the relatives and rented house, further the wife of his brother stated that co-accused, Bablu Thekedar had taken his brother and son on bike and further he left the son of the deceased and said that the brother of the informant went

It is further alleged that on 05.06.2022, the informant got an information that a dead body was found in Lakho Police Station. Thereafter, the informant identified the dead body of his brother and lodged F.I.R. against the petitioner and two other co-accused persons.
4. Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in this case. It is further submitted that the deceased, Abdul Wakil with his wife Shabnam Praveen @ Guriya were residing on rent in the house of the petitioner since last one year. It is further submitted that there is no specific allegation against the petitioner, petitioner is a landlady of Abdul Wakil only on suspicion, she dragged in this case. Lastly, it has been submitted that she has clean antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Begusarai Town P.S. Case No. 329 of 2022, she will be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with
Patna High Court CR. MISC. No.47603 of 2023(2) dt.11-08-2023 3/3 two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to condition as laid down under Section 438(2) of the Cr.P.C.
