The petitioner seeks bail in connection with Trial No.1169 of 2014, arising out of Motihari Town Police Station Case No.146 of 2013 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that in course of investigation of Town Police Station Case No.118 of 2013 registered under Section 386 of the Indian Penal Code, police apprehended the petitioner and one Ravi Kumar and in course of search, one loaded country made pistol and three mobile sets having SIM numbers were recovered from the possession of the petitioner.

No.48711 of 2014 (2) dt.03-03-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that after being apprehended by the police in the present case on 10.04.2013, the petitioner has been remanded in three other cases bearing Chiraiya P.S. Case No.264 of 2012, Motihari Town P.S. Case No.118 of 2013 and Chharodano P.S. Case No.35 of 2013, which were lodged against unknown, and in all the aforesaid three cases, the petitioner is on bail. Except that, there is nothing against the petitioner to connect him in the commission of the alleged offence.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari (East Champaran) in connection with Trial No.1169 of 2014, arising out of Motihari Town P.S.
