JUSTICE BIRENDRA KUMAR ORAL ORDER 20-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420/384/341/323/379/504/506/34 of the Indian Penal Code. The informant had entered into an agreement for development of building on his land with co-accused Pravin Kumar. Pravin Kumar was not making constriction as agreed within time. Hence, some altercation took place with Pravin Kumar. The petitioners were also present at the time of occurrence of altercation. Allegation is that the petitioners demanded ransom and snatched money from the pocket of the informant.

Patna High Court Cr.Misc. No.44870 of 2017 (2) dt.20-09-2017 P2/ Submission of the learned counsel for the petitioners is that just due to non-fulfillment of commitment by Pravin Kumar, false cases one after another being lodged and the petitioner has already been allowed anticipatory bail in Danapur P.S. Case No.100 of 2017 by this Court in Cr. Misc. No.30386 of 2017.

Considering the background of allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna/successor Court in connection with Danapur Police Station Case No. 167 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
